TAKE NOTICE THAT on June 10, 2024 an order was made for service on you of a Petition to the Court issued from the Chilliwack Registry of the Supreme Court of British Columbia in proceeding number CHI-S-S-39825 by way of this advertisement.
In the proceeding, the Petitioners, Kathleen Ann Watson, Daniel Kelly Patrick, Lynda Susan Patrick, Heather Gayle Brooks, Irene Sophia Heenan, Janet Elaine Johnson, and Teresa Lynn Oades, claim the following relief against you:
1. An order that the lands and premises legally known and described as:
PID: 002-113-503, LOT 10 SECTION 14 TOWNSHIP 5 RANGE 26 WEST OF THE 6TH MERIDIAN YALE DIVISION YALE DISTRICT PLAN 11576 (the “Property”)
be sold forthwith, by private sale, free and clear of all encumbrances, save and except a statutory right-of-way in favour of the Regional District of Fraser-Cheam registered under number V7087;
2. An order that the Petitioners have exclusive conduct of sale of the Property and be at liberty forthwith to list the Property for sale for a period commencing forthwith until further Order of the Court;
3. An order that the Petitioners be granted an option to purchase the Property for gross sale proceeds in an amount subject to the approval of the Court unless otherwise agreed by all parties;
4. An order that the sale of the Properties shall be subject to the approval of the Court unless otherwise agreed by all parties;
5. An order that the Respondents, or any person or persons on behalf of the said Respondents, including any person or persons in possession of the Property do forthwith and until further Order of the Court, permit any duly authorized agent on behalf of the Petitioners to inspect, appraise, or show to any prospective purchaser the Properties including the interior of any buildings located on the Property between 9:00am and 8:00pm Monday through Sunday inclusive, but excluding statutory holidays, and to post signs on the Property stating that the Property is offered for sale;
6. An order that the net sale proceeds from the sale of the Property shall be paid out in accordance with the following priorities:
(a) Firstly, in payment of taxes, interest and penalties on arrears of taxes, owing in respect of the Property sold;
(b) Secondly, in payment of selling commissions and applicable taxes thereon; and
(c) Thirdly, the balance of the sale proceeds be divided amongst the parties proportionately in accordance with their respective ownership interests in the Property sold;
7. An order that the Petitioners are entitled to their costs of this proceeding.
You must file a responding pleading/response to petition within the period required under the Supreme Court Civil Rules failing which further proceedings, including judgment, may be taken against you without notice to you.
